The Problem and Insurance Solution
In the contractor work insurance policy, there is an exclusion of liability related to personal injury resulting from the use of mechanical engineering equipment that is a motor vehicle as defined in the Traffic Ordinance, which is not legally required to be insured.
The background to this exclusion is a change in the Ministry of Transportation regulations starting January 1, 2002, when the Ministry of Transportation removed a long list of heavy construction equipment from the list of vehicles requiring mandatory insurance, and from that date they are not required to have mandatory insurance, and therefore insurance companies stopped issuing mandatory insurance for them.
A significant part of these tools are common at construction sites. Special attention should be given to tower cranes that have been prominent in many accidents in recent years, as well as to the scissor lifts common at many construction sites.
The significance for the construction site is critical, as mentioned, the third-party insurance section in the contractor's policy excludes coverage for personal injuries caused by these tools, therefore the exclusion must be canceled in advance so there will be insurance coverage, contrary to what is stated in the policy's exclusions.
