This may sound surprising to you, but it turns out that the legal and regulatory concepts in Israel differ from the common concepts in the construction industry. And this isn't about professional terms like - 'shtikhmus,' 'shnogeris,' or 'tapleh' which have very clear Hebrew translations, but about occupational terms and definitions that have legal meaning.
Thus, for example, the law does not recognize the concept of 'general contractor [lit. key contractor].' The only reference in the law from a criminal and tort perspective is to the "construction performer." And thus, according to Israeli law, responsibility at a construction site is mainly placed on two entities: the "construction performer" and the "work manager."
And yet there remains ambiguity here that needs clarification:
Some regulations place responsibility in certain matters on the work manager and some regulations place responsibility in other matters on the construction performer. While we all know who the work manager is, the definition of construction performer remains vague, since under this role definition could be the developer or work orderer or a main contractor appointed in writing by the work orderer/developer and who gave written consent to this.
