A durable power of attorney is a legal document that allows a person (hereinafter: the " appointee ") to appoint another person (hereinafter: the " proxy ") to make decisions and perform actions on his behalf, when the appointee will not be able to act on his own due to a cognitive impairment due to a medical condition or an accident. This is an essential tool for managing a person's personal, medical and financial affairs, which guarantees that the power of attorney will act in accordance with the desires and instructions of the appointer, when he himself will no longer be able to make decisions on his own.
What is a durable power of attorney?
A durable power of attorney is a legal document regulated in the Legal Training and Guardianship Law, 1962, which was enacted as part of amendment number 18 to the law in 2016. This document allows the appointee to define in advance how his affairs will be handled in the future, and to appoint one or more people to make decisions for him in the event of loss Cognitive ability, illness, or any situation in which the appointer will no longer be able to manage his affairs by himself.
The amendment to the law gives a person the freedom to choose ahead of time the route that suits him on the day of the order.
Three main areas can be included in the ongoing power of attorney:
Personal matters : participation in family events, holidays, welfare, housing and any matter that does not concern property.
Medical matters : making decisions regarding medical treatments for which an appointment will be required.
Property matters : asset management, bank accounts, investments and any other financial matter.
The appointor can choose to include all these areas in the lasting power of attorney, or limit the document to a certain area only.
Control and free will : The appointer determines ahead of time his wishes and instructions regarding the management of his affairs, without these decisions requiring court approval or being subject to the discretion of relatives who do not necessarily know his wishes.
Prevention of family conflicts : A lasting power of attorney allows you to prevent disputes within the family regarding medical or financial decisions in the event that the appointor can no longer make decisions on his own.
Flexibility : it may appoint one or more proxies, establish detailed preliminary instructions, and specify additional people who must be consulted or informed about the implementation of the decisions.
Autonomy : The document guarantees that the decisions made will be in accordance with the values and wishes of the appointee, without the need for court approval.

ייפוי כוח מתמשך חייב להיערך בפני עורך דין שהוסמך לכך על ידי משרד המשפטים. עורך הדין יוודא שהממנה מבין את משמעות המסמך ואת השלכותיו, ושהממנה נותן את הסכמתו החופשית והמודעת למינוי מיופה כוח לקבלת החלטות עבורו, בהתאם להנחיותיו המקדימות.
לאחר חתימת המסמך על ידי הממנה ועורך הדין, יופקד המסמך אצל האפוטרופוס הכללי, שם יישמר עד ליום מימושו. ייפוי הכוח המתמשך ייכנס לתוקף רק כאשר יתקיים תנאי שנקבע במסמך, כגון אובדן כושר קוגניטיבי או חוסר יכולת לקבל החלטות. מיופה הכוח חייב לפעול בהתאם להנחיות שניתנו במסמך ולהגיש דיווחים תקופתיים למשרד המשפטים, רק אם נדרש לכך.
ייפוי הכוח המתמשך יפקע כאשר מתקיימים תנאים מסוימים, כגון פטירת הממנה, פקיעת ייפוי הכוח לפי תנאי המסמך, או ביטול ייפוי הכוח על ידי הממנה בטרם נכנס לתוקף, בהיותו כשיר לקבל החלטות.
